
Have you been to a playground that is “accessible” to all children in your home town? Take a look at the “accessible” features on those playgrounds and think to yourself how do children who cannot walk enjoy this playground as much as all of the other children? The American Disabilities Association has set a standard for all accessible points of interest so that all children/Adults may have an equal opportunity to enjoy facilities that do not hinder them in any way. Playgrounds are no different and not excluded from this, All parks and recreational facilities must comply to the rules and regulations set forth by The United States Government as explained by Section 1008.1 of the ADA Compliance code, However like most of the legal documents we all have come to know have what is called “Loop-holes”. As stated by the ADA website :
240.2.1.1 Minimum Number and Types. Where ground level play components are provided, at least one of each type shall be on an accessible route and shall comply with 1008.4.
240.2.1.2 Additional Number and Types. Where elevated play components are provided, ground level play components shall be provided in accordance with Table 240.2.1.2 and shall comply with 1008.4.
EXCEPTION: If at least 50 percent of the elevated play components are connected by a ramp and at least 3 of the elevated play components connected by the ramp are different types of play components, the play area shall not be required to comply with 240.2.1.2.
Do you see the loophole here? An accessible route by definition of the ADA can be either ramps (preferably) or by as stated by section 1008.3.1
The TMS Foundation has built many FULLY ACCESSIBLE playgrounds for children. These playgrounds are a place where mobility impaired children can roam freely along side of their friends and family without feeling left on the sidelines and becoming even more independent while at the playground. These playgrounds will start in the NJ,NY,PA and DE areas and reach across the nation.
